Welcome

The following Terms and Conditions, together with our Privacy Policy, outline your rights and responsibilities when using our website, they apply whether you are browsing or purchasing goods.

If you do not agree with any of these Terms and Conditions, please do not use our website.

Fabric Shed reserves the right to end our agreement with you and to terminate access to the website should you breach any of these terms and conditions.

Should our Terms and Conditions change we will post information about that change on Social Media accounts and the account page of our website for 30 days and alert customers to the change via our newsletter. Each time you use our site you are agreeing to the Terms and Conditions as of that date/time and so we recommend reviewing Terms and Conditions on each visit (to make this easier any changes will be highlighted at the top of the Terms and Conditions web page).

These Terms and Conditions do not affect your statutory rights.

General Terms

You must be over 18 years old to buy goods from this site. If you are under 18, you can only use this site with the involvement of a parent or guardian.

Products sold on printstopolkadots.co.uk are for private domestic and consumer use only. We do not accept liability for any indirect loss, consequential loss, loss of income or profit, loss of damage to property and/or loss from claims of third parties arising out of the use of the site or products purchases thereon.

To the extent permitted by law, Fabric Shed gives no warranties in relation to the website and freedom from viruses. We do our best to keep our site up to date but cannot guarantee that the site is completely free of technical errors, viruses or anything else that may have a harmful effect on your computer or any technology.

Account Management

If you choose to set up an account with us you will be asked to choose a username and password.

You are responsible for keeping those details secure and for all actions taken using said username and password. If you think the security of your password has been breached you are responsible for changing your password.

You are responsible for keeping your account details upto date, should your details change and as a result an order is undeliverable (change of address for example) you will be liable for the additional costs incurred, for example in rerouting the delivery.

Product Descriptions & Images

We make every effort to ensure that images and product descriptions accurately reflect products for sale. However screen contrasts can differ from device to device and some colours could be described in more than one way. We cannot be held responsible or liable for any differences in colour between the image/text and the actual product. Should you be unhappy with your purchase our No Quibbles Returns Policy will be used to resolve the matter.

We do not accept liability for errors and/or omissions on our website and reserve the right to change information, specifications and descriptions of listed goods, products and services at any time and without notice. Should any such errors be discovered after your order has been despatched, our No Quibbles Returns Policy will be used to solve the matter.

Images and text remain the property of Fabric Shed and all rights, including copyright, are controlled by Fabric Shed. You are not permitted to copy, broadcast, download, store, transmit, show or play in public, adapt or change in any way the content of the website (including blog posts) without the prior written permission from Fabric Shed.

You may link to printstopolkadots.co.uk, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. Any link should not suggest any form of association or endorsement by Fabric Shed where none exists. For such an association to be valid you will need written consent from Fabric Shed.

Prices

Every effort is made to ensure that the correct price is shown against each product on our site. If an error is discovered and your goods have not yet been shipped, we will contact you to determine how you would like to proceed (neither party will be under any obligation to complete the transaction). Once your goods have been shipped our contract of sale with you has been formed and no changes to the price will be made,

VAT

All prices are inclusive of VAT. Should you require a VAT receipt please contact us using the form below with your order number and we will provide a VAT receipt within 7 working days.

Links to Third Parties

From time to time we will provide links from our website to other websites and resources. If you choose to follow those links you agree that you do so at your own discretion. You acknowledge and agree that we are not responsible or liable, directly or indirectly, for (i) the privacy practices of such websites, (ii) the content of such websites or for any loss or damage that may arise from your use of them.

Orders

When placing an order you warrant that:

all details provided by yourself are true and accurate
that you are over 18
that you are the cardholder of the credit or debit card used to pay for the order (or account holder in the case of Paypal) and that sufficient funds are available to cover payment.

We will confirm receipt of your order by e-mail. Orders placed by you are an offer to purchase and will be accepted by us, subject to stock availability.

The contract for the sale of the goods will be formed when we send an e-mail confirming despatch of your order.

For most products your credit/debit card will be charged when your order is placed.

Shipping

A range of shipping options will be offered at checkout. Only options which expressly state they including tracking or signature are trackable. If you choose to use a non-tracked option, such as Royal Mail 1st or 2nd class post, you do so acknowledging that the order will not be trackable.

We aim to despatch orders within 3 working days but this is not always possible. We agree to make all reasonable efforts to send your order in good time but in accepting these Terms and Conditions you acknowledge and accept that this is not a guaranteed despatch time, and that you are liable for any loss incurred by yourself as a result of this aim not being met.

If you are ordering from overseas please note that you are responsible for any customs fees or taxes levied on your order.

Returns

We offer a 30 day returns policy for all goods. If you receive your order and decide you no longer want all or part of the order, start the returns process by emailing us at customerservices@printstopolkadots.co.uk. It is important that you contact us before returning the item/s so that we can ensure the most appropriate method of return is used. By agreeing these Terms and Conditions you accept that should you choose not to contact us before making the return, the cost of that return may not be covered.

Damaged or Incorrect Items

In the case of damaged or incorrect items we will offer a refund or replacement of the item, and cover the cost of return. It is important that you contact us before returning the item/s so that we can ensure the most appropriate method of return is used. By agreeing these Terms and Conditions you agree to contact us before returning items.

Change of Mind

As long as the goods are in their original condition, we are happy to accept returns on the basis of a change of mind. In this case we will refund the cost of the item/s returned but not cover the cost of return postage.

Privacy & Cookies

All information relating to your account will be held securely by Fabric Shed. Data is held on a secure server and we fully comply with all applicable privacy regulations and consumer legislation.

The Contract

If any of the provisions of these Terms and Conditions are found to be unlawful, invalid or otherwise unenforceable by any court or other authority, that those provision(s) shall be deemed severed from the remainder of these Terms and Conditions. The remainder of these Terms and Conditions shall be valid and enforceable.

No failure or delay by us in exercising any of our rights under these Terms and Conditions means that We have waived that right, and no waiver by Fabric Shed of a breach of any provision of these Terms and Conditions means that we will waive any subsequent breach of the same or any other provision.

Rights under these Terms and Conditions can only be exercised by the parties entered into the agreement and not third parties.

Changes to the Terms and Conditions

Liability

We will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise out of or in connection with the Terms and Conditions for:

any economic losses (including without limitation loss of revenues, profits, contracts, business or anticipated savings); or
any loss of goodwill or reputation; or
any special or indirect losses
suffered or incurred by that party arising out of or in connection with the provisions of any matter under the Conditions.

Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our servants, agents or employees.
